Effective Date: January 1, 2026
These Terms and Conditions ("Terms") govern your use of the website located at thousandoaksconcreteconstruction.com (the "Site") and any services provided by TKO Thousand Oaks Concrete ("Company," "we," "us," or "our"). By visiting our Site or requesting services, you agree to these Terms. If you do not agree, do not use our Site or services.
1. Acceptance of Terms
By accessing our Site or contacting us to request services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
TKO Thousand Oaks Concrete provides residential and commercial concrete contracting services in Thousand Oaks, CA and surrounding areas, including but not limited to:
- Concrete driveways, patios, and sidewalks
- Stamped and decorative concrete
- Foundations, slabs, and footings
- Retaining walls and concrete steps
- Pool decks, garage floors, and concrete cutting
All services are subject to the availability of our crew, permitting timelines, and site conditions at the time of scheduling. We reserve the right to decline any project that we determine is outside the scope of our services.
3. Estimates and Pricing
Estimates provided by TKO Thousand Oaks Concrete are based on information available at the time of the assessment, including measurements, site conditions, and your stated project requirements. Please note:
- An estimate is not a fixed contract price until both parties have signed a written contract.
- Changes in project scope, site conditions discovered after work begins, or changes in material costs may result in price adjustments. We will notify you before proceeding with any work that would result in additional charges.
- Verbal estimates are not binding. All pricing should be confirmed in writing before work begins.
4. Scheduling and Cancellation
Scheduling: Once you accept a written estimate, we will provide you with a scheduled start date. We make every reasonable effort to begin on the agreed date. Delays due to weather, material availability, permit processing, or conditions beyond our control may require rescheduling. We will communicate any changes as early as possible.
Cancellation by Client: If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after materials have been ordered or after work has begun may be subject to fees to cover costs already incurred, including material costs and labor for work completed.
Cancellation by Company: We reserve the right to cancel or reschedule a project due to unsafe conditions, permit delays, or circumstances beyond our control. In such cases, we will refund any deposits paid for work not yet performed.
5. Payment Terms
Payment terms will be specified in your written contract. General payment terms are as follows unless otherwise agreed in writing:
- A deposit may be required before work begins, as specified in the contract.
- Remaining balances are due upon completion of the work, unless a different payment schedule is agreed upon in writing.
- Accepted payment methods will be specified at the time of contract. We do not accept large upfront cash payments as a sole payment method.
- Late payments may be subject to interest charges as permitted by California law.
Work will not begin until any required deposit is received. We reserve the right to stop work if payment is not received per the agreed schedule.
6. Permits and Compliance
Where required, TKO Thousand Oaks Concrete will obtain necessary permits from the City of Thousand Oaks or other applicable authorities on your behalf. Permit costs are typically included in the project quote unless noted otherwise. We perform all work in compliance with applicable local building codes and regulations. You are responsible for ensuring that any HOA or deed-restriction approvals required on your property are obtained before work begins.
7. Workmanship Warranty
We stand behind the quality of our work. We warrant that our labor and workmanship will be free from material defects caused by the installation process for a period specified in your written contract. This warranty does not cover damage resulting from normal wear and tear, ground movement caused by seismic activity or expansive soils, acts of nature, improper maintenance, or modifications made by others after project completion. To make a warranty claim, contact us at team@thousandoaksconcreteconstruction.com within the warranty period.
8. Warranty Disclaimers
Except for the express workmanship warranty described above, our services and website are provided "as is" without warranty of any kind, whether express or implied. We do not warrant that our website will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by applicable law.
9. Limitation of Liability
To the maximum extent permitted by CA law, TKO Thousand Oaks Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from our services shall not exceed the amount actually paid by you for the specific services giving rise to the claim.
10. Dispute Resolution
We encourage you to contact us directly to resolve any concerns or disputes before taking formal action. Most issues can be addressed through open communication, and we are committed to working with you to find a fair resolution.
If a dispute cannot be resolved through direct communication, the parties agree to attempt to resolve it through mediation before initiating arbitration or litigation. Any legal action not resolved through mediation shall be submitted to binding arbitration in Thousand Oaks, CA, in accordance with the rules of the American Arbitration Association. Nothing in this section prevents either party from seeking injunctive or emergency relief from a court of competent jurisdiction.
11. Governing Law
These Terms and any disputes arising from or related to our services or website shall be governed by and construed in accordance with the laws of the State of CA, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of courts located in CA for any matters not subject to arbitration.
